CHARTERBOATSINC.COM acts only as a charter boat reservations service agency to help facilitate the booking of charter fishing trips. It expressly disclaims and shall be free of all responsibility or liability for any act, error, omission, injury, loss, accident, delay, neglect or default of any person providing any service or due to any cause whatsoever occurring during a charter.

CHARTERBOATSINC.COM has developed a unique relationship with charter fishing Owners and Captains that find it mutually beneficial to facilitate charter bookings, but does not control any of their charter fishing services. We do not assume responsibility for any of the charters, although we research to the best of our ability to insure that you will be booked into a quality charter. Variations in charters may be experienced.

CHARTERBOATSINC.COM does not assume responsibility for any verbal agreements between yourself and a charterboatsinc.com representative, that are not expressed in writing.

CHARTERBOATSINC.COM limits its responsibility to the booking fee (paid by charter company, not customer) and will not be held responsible for telephone costs, transportation fares, or other costs of a personal nature incurred during travel.

THE LAW

WHO IS RESPONSIBLE FOR COPYRIGHT INFRINGEMENT?
Any party who participates in copyright violation may be responsible. It does not matter whether the individual knows that a violation is being committed. Remember: Ignorance of the law is not a valid defense. YOU MUST REFUSE to be a party to any copying or use of designs, derivative works, or design features by being certain of the original source and permissions. To do so is ILLEGAL.

RESPECT THE DESIGNERS COPYRIGHTS

In the event of a suspected violation of a copyright, or if there is any uncertainty about this, the publisher and/or designer should be contacted before proceeding.

PENALTIES FOR INFRINGEMENT

Penalties for violating copyright may be severe. The responsible parties are required to pay actual damages caused by the infringement (which may be substantial), plus any profits made by the infringer. The copyright law also allows for recovery of statutory damages, which may be as high as $150,000 for each infringement. Finally, the infringer may be required to pay legal fees, which often exceed the damages.

Copyright law has been reinforced in recent years. Willful infringement could cause settlements for statutory damages up to $150,000 plus attorney fees, damages and loss of any profits derived while copyrighted material is in use.
These legal protections exist to protect all parties.
